Covid-19 makes following many visitation orders difficult. Visitation is an individual matter defined by parenting plans that do not likely anticipate a pandemic. The new rules we live in raises many concerns over travel, the possibility of infection as children switch houses to meet agreed visitation. The most common question we get now is how to handle visitation when the other parent continues to go to work in an essential business. We even had a call about how someone that works at a coronavirus testing location impacts visitation.
The answer to these problems is not simple. Each case is extremely individual. Visitation is based on your facts and any parenting plan in effect. The more detailed the parenting plan the easier it is to answer questions on how your changed life impacts it. The problem is that too many parenting plans, especially ones created by pro se parties (parties who worked without attorneys), are just general statements that visitation shall be “liberal and reasonable as” and “as agreed to by the parties”. Two parties who could not get along well enough to work out visitation on their child or children still left visitation with no rules in an plan that was supposed to define rules. Not good, but we can help.
We have solutions to even the worst parenting plans. These solutions can e working out new schedules, adding in video conference visits, adding visitation time to after the coronavirus pandemic is no longer an issue, and much more. Experienced family law attorneys have experience working out creases in parenting plans. Using all social distancing we can help you to negotiate a parenting plan modification that works for you.
